LA Dodgers’ Marriage Agreement Not Worth the Paper It’s Written On

After months and months of litigation, mediation, and settlement conferences, Los Angeles Superior Court Judge Scott Gordon has finally made the decision that Frank and Jamie McCourt could not.

The Court ruled that the marriage agreement which purported to give Frank McCourt sole ownership of the Dodgers’ baseball team was invalid and unenforceable for the simple reason that a second set of marriage agreements signed by the McCourt’s said that the baseball team did not belong solely to Mr. McCourt. In the face of two different agreements, the Judge held that there was no “meeting of the minds” on the terms of their agreement and thus, no agreement.

So what’s next? The court action to date will appear to be a minor skirmish compared to the litigation to determine whether the baseball team is part of the marital community property of the McCourt’s. Yes, they could agree to settle the issue but their track record on compromise would suggest that a bigger battle is in the offing.

Possible outcomes include the sale of the team to pay out one or both parties and continuing uncertainty with respect to the future of the LA Dodgers.

Marital disputes have wreaked havoc for other professional sports teams including the San Diego Padres, however, John and Becky Moore agreed that the team was a family asset and a settlement was reached which saw Mr. Moore bring in new partners to retain the team and acquire funds to payout his wife.

My guess is that the McCourt’s will fight this to the finish. Sad and stupid.
